AMARILLO, Texas (KVII) — The teen accused of shooting two first responders and a bystander at the Tri-State Fair in Amarillo is headed to a trial.
Court records show that 17-year-old Elezar Suarez was indicted Thursday on two cases of aggravated assault against a public servant.
Both charges are first-degree felonies, carrying a sentence of five to 99 years in a Texas prison per charge.
Suarez stands accused of opening fire at the fair on Sept. 19, hitting a Potter County deputy, a firefighter and another bystander.
Officials said the shooting started in the aftermath of a fight - and deputies returned fire once shots rang out, hitting Suarez and sending him to the hostpital.
All three deputies who shot at the teen were cleared of charges by a grand jury.
Police said Suarez was out on parole for an unrelated charge when the shooting happened.
Eventually all victims were released from the hospital - and the two first responders were honored by the Potter County Commissioners Court for their efforts in putting an end to the violence.
Suarez himself spent time in the hospital to treat his gunshot wounds and was booked into jail on Oct. 11.
Court records do not yet show when his trial will start.
