POTTER COUNTY, Texas (KVII) — A man who is accused of taking part in a robbery of a La Bella's Pizza in 2018 that resulted in one of the other robbers being shot and killed was indicted for murder.

According to court records, a Potter County Grand Jury has indicted Ruben Ryel Rios, 31, for murder.

Rios and Clayton Jerrell Morgan attempted to rob the La Bella's Pizza on Olsen on January 9, 2018. According to APD, during the robbery attempt, Morgan pointed a weapon at an armed employee and was shot and killed. Rios was a few hours after the robbery attempt in the parking lot of an apartment complex on Canyon Drive.

Texas law permits people to be charged with murder if they take part in a crime in which another person is killed, even if they did not do the killing, according to police.
