2001-04-19

On April 19, 2001, Donald Heath, 62, was working the midnight shift as a store clerk for Toot-N-Totem at 211 S. Western. A suspect entered the store, shot and killed Mr. Heath. A suspect was arrested shortly after this homicide, but was later released after an eyewitness was found to have been lying. In August 2006 this case was re-opened by Off. Rifenberg and Sgt. Kevin Dockery.

Off. Rifenberg reviewed videotape of the homicide and took it to a local photo shop to see if it could be enhanced. Off. Rifenberg had seen a shadow on the neck of the suspect who was wearing pantyhose over his head during the commission of this homicide. Enlargements of these frames indicated that this shadow was rectangular in design. An additional suspect had been identified during the original investigation and this enhanced photo was compared to him.

This suspect, Milo Williams, was found to have a rectangular birthmark on the right side of his neck as well as hair on his chin that matched the suspect in the video. Additional witnesses were located that gave information that Milo Williams had committed this homicide during a planned theft.

The video showed that the suspect did not attempt to commit a theft, but instead just entered the store and shot Mr. Heath a single time and left. In February 2007 this case was presented to a Potter County Grand Jury, that indicted Milo Williams on a charge of murder.
