Personally appeared before me, the undersigned authority, CORY JONES, the Affiant, and who after being by me duly sworn, deposes and says: Affiant has good reason to believe and does believe that, AUNG NAI MYO, on or about the 28th day of August, 2022, and before the making and filing of this Complaint, in Potter County, Texas, did then and there, with intent to cause serious bodily injury to an individual, namely, JU NOK, commit an act clearly dangerous to human life that caused the death of JU NOK, by striking him with a hammer.

MY BELIEF IS BASED ON THE FOLLOWING FACTS:

Affiant has participated in the investigation of the offense alleged above and has received information that law enforcement officers learned the following facts after investigating the offense alleged above:

Li Are, an eyewitness who knows the defendant and has no known criminal record, was interviewed by an officer of Amarillo Police Department. Mr. Are stated that the defendant and the decedent, Ju Nok, had argued earlier in the day.

The decedent lived next door to Mr. Are. Mr. Are stated that the defendant left Mr. Are's residence for a short period then returned to Mr. Are's residence. Mr. Are observed the defendant to have blood on his clothing.

Defendant told Mr. Are that he had made entry into decedent's residence and that defendant and decedent had fought. Soon thereafter, the defendant left Mr. Are's residence.

Ah Bi was interviewed by an officer of Amarillo Police Department. Mrs. Bi, an eyewitness who has no known criminal record, was shown a photograph of the defendant and others, and she identified the defendant as the person she observed outside the decedent's residence engaged in a verbal argument with Mr. Nok, who was inside his residence.

Mrs. Bi then observed the person she later identified as the defendant, kick in the door of the decedent's residence and make entry into the residence. Mrs. Bi later observes the defendant exit the decedent's residence and leave the area on a bicycle. Investigating officers later recover surveillance video from Eastridge Elementary that shows the defendant riding past the school on what is later discovered to be a bicycle belonging to the decedent.

Amarillo Police Department CSI personnel later recover clothing from the defendant's bedroom bearing bloodstains and a hammer believed to have been used in the commission of this offense. When the defendant was contacted by law enforcement, he was observed to have blood on his person.

Mr. Nok was transported from the scene by AMS and subsequently died of his injuries. At autopsy, the preliminary cause of death was determined to be from injuries sustained due to blunt force trauma.
