On Dec. 18 at 6:15 p.m., Amarillo police officers were sent to the 3300 block of SW 10th on a possible burglary in progress. Upon arrival officers spoke with the caller, who turned out to be the homeowner's son. He advised that there were two individuals inside his father's house and that he didn't know who they were or why they were there.
Officers approached the house, and saw a man and woman in the living room. Officers asked the couple to come outside and talk to officers, and they complied. The man, Kyle Walter Patton, 32, said that the house belongs to his grandfather who has mental health issues that cause his memory not to work well, and that his grandmother had recently passed away.
As officers continued with their investigation, they learned that the woman, Shelby Brianna Funk, 20, had several outstanding warrants. Fun k was handcuffed and placed in the back seat of a police car. Officers told Patton that he was being detained in the investigation due to the burglary call. As Patton was being handcuffed, he asked the officer if he could get the money out of his pocket and give it to Funk for her bond. The officer complied with his request, placed his hand inside the pocket and discovered narcotic paraphernalia. A further search revealed a bag of marijuana in a coat pocket that Patton was wearing.
A short time later, the homeowner and his wife arrived at the house. The homeowner said he didn't know Patton and Funk and did not give them permission to be in the residence.
The couple were transported and booked into Potter County Correction Center. Patton was charged with burglary of habitation, possession of marijuana over two ounces less than four ounces, and possession of drug paraphernalia.
Funk was charged with burglary of habitation, three Potter County warrants, one for unlawfully carrying a firearm, one for failure to produce identification as a felon, and a capias pro-fine Class A theft.

A local couple was arrested on multiple charges, including burglary after officers received reports of two people inside a home without permission in Amarillo's San Jacinto neighborhood, police said Friday.
Kyle Walter Patton, 32, and Shelby Brianna Funk, 20, were arrested about 6:15 p.m. Thursday after Amarillo police responded to the 3300 block of Southwest 10th Avenue in response to reports of a burglary in progress.

At the home, the homeowner's son told officers that two people he did not know were inside his father's house, police said.
Police asked the man and woman inside to come out and talk, and they complied.
Patton told police the house belonged to his grandfather who suffered from memory loss and mental health problems and had recently lost his wife, police said.
As police tried to sort out the details, they learned Shelby Funk was wanted on multiple outstanding warrants from Potter County. Officers placed Funk in handcuffs and sat her in the back of a police car while they investigated.
Officers decided to detain Patton in the burglary investigation. As police were placing handcuffs on Patton, he asked if an officer could reach into his pocket and retrieve money to pay for Funk's bail bonds, police said.
When the officer reached into Patton's pocket to retrieve the money, he discovered he had also grabbed drug paraphernalia, police said.
After that discovery, police searched Patton and found a bag of marijuana in his coat pocket.
Then the homeowner and his wife returned home, police said.
The homeowner told police he did not know either Patton or Funk, and neither had permission to be in his home.
Both Patton and Funk were booked into Potter County jail on a charge of burglary of a habitation, police said. Patton also faces charges of possession of marijuana more than 2 ounces but less than 4 ounces, and possession of drug paraphernalia. Funk was also booked on three outstanding Potter County warrants on original charges of unlawfully carrying a firearm, failure to identify as a fugitive from justice and theft.
