On May 13,2020, an Amarillo Police Department undercover officer (APD UC) made contact with Demarcus Dave Grabert through Snapchat. The UC officer asked Grabert if he could sell psilocin mushrooms to the UC. Grabert replied that he could sell the UC psilocin mushrooms. Grabert quotcd the UC the price for one ounce of mushrooms, which was $250.

On May 14,2020, Grabert agreed to meet the UC at the Silver Oak Apartments located at 17 i0 SE 34th Ave, Amarillo, Texas. At 1:57 p.m', the UC texted Grabert to let him know that the UC was at the Apartment complex. Grabert arrived at the location in a black Pontiac. The UC opened the passenger door of Grabert's vehicle. Grabert placed a clear Ziplock baggie containing the psilocin mushrooms on the passenger seat. The UC handed Grabert $250. Grabert told the UC that he could sell the UC additional psilocin mushrooms in the future.
